Beyond DACA recipients, the Final Rule brings about significant changes to the definition of “lawfully present” for Marketplaces and Basic Health Programs (BHPs), positively impacting additional groups of noncitizens. Notably, noncitizens with work authorization are now recognized as lawfully present for Marketplace coverage, irrespective of their underlying immigration status. This pivotal change enables access to coverage using documents like an Employment Authorization Document (EAD).
Furthermore, Family Unity Beneficiaries, previously ineligible, can now access Marketplace and BHP coverage.
